1. Agreement to These Terms
By creating an account, browsing, buying, selling, listing a card, or otherwise using SwankageTCG, you agree to these Terms and any marketplace policies displayed on the site. If you do not agree, do not use the marketplace. You must be legally capable of entering into a binding agreement in your jurisdiction, or use the service with the permission and supervision of a parent or legal guardian where permitted.
2. SwankageTCG Is a Marketplace
SwankageTCG provides technology that helps customers and independent vendors find one another and transact. Unless a listing expressly states that SwankageTCG itself is the vendor, the vendor—not SwankageTCG—is responsible for the card being offered, its description, condition, authenticity, ownership, packaging, shipment, and fulfillment. SwankageTCG may facilitate payments, marketplace tools, communications, dispute workflows, and other services, but does not take possession of every item listed by third-party vendors.
3. Accounts & Security
You are responsible for providing accurate account information and for keeping your login credentials secure. You are responsible for activity that occurs through your account unless applicable law provides otherwise. You may not impersonate another person, create accounts for fraudulent purposes, misuse another user's information, or attempt to bypass account restrictions, marketplace fees, fraud controls, or security features.
4. Buying Cards
Customers are responsible for reviewing the specific vendor, listing price, card condition, language, printing, grading details, shipping method, and any other listing information before completing a purchase. Card images, condition descriptions, grades, and vendor statements are provided for shopping purposes, but customers should ask questions before purchasing whenever a material detail is unclear. Prices, availability, and quantities may change until checkout is completed.
5. Selling Cards
Vendors may list only items they are legally permitted to sell and must describe cards accurately and in good faith. Vendors are responsible for accurately stating condition, set, card number, printing, language, grading information, authenticity, price, quantity, and other material details. Counterfeit, stolen, misrepresented, or otherwise prohibited items may be removed, and vendor privileges may be limited or suspended. Vendors are responsible for fulfilling paid orders promptly and packaging cards appropriately for the selected shipping method.
6. Shipping, Delivery & Carrier Risk
Once a vendor has properly tendered a package to an independent shipping carrier, SwankageTCG does not possess or control that package. To the maximum extent permitted by applicable law, SwankageTCG is not responsible for packages that are lost, stolen, damaged, delayed, misdelivered, destroyed, or otherwise affected while in the possession or control of USPS, UPS, FedEx, DHL, or any other third-party carrier.
Customers and vendors should use appropriate packaging and are encouraged to use tracking, delivery confirmation, signature services, and insurance when the value of a shipment warrants it. Carrier claims generally must be pursued with the carrier and may require the cooperation of the sender. SwankageTCG may provide marketplace dispute tools or assistance, but doing so does not make SwankageTCG the shipping carrier, insurer, or guarantor of delivery.
Nothing in this section limits any consumer right, statutory remedy, or other protection that cannot lawfully be waived.
7. Returns, Refunds, Chargebacks & Disputes
Returns and refunds are subject to the applicable listing terms, vendor obligations, SwankageTCG marketplace policies, payment-provider rules, and non-waivable consumer laws. Users should attempt to resolve order issues through the marketplace's support and dispute tools before initiating an external payment dispute where permitted. SwankageTCG may request photographs, tracking information, messages, grading information, or other evidence when reviewing a dispute.
8. Market Values, Pricing & Catalog Information
Market values, price guides, historical prices, card counts, rarity information, images, set data, and other catalog information are provided for convenience and informational purposes. They are not appraisals, guarantees, offers to buy, or promises that a card will sell for a particular amount. Actual sale prices vary based on condition, grading, language, printing, vendor reputation, supply, demand, shipping, fees, and other factors. Customers and vendors remain responsible for deciding what price they are willing to pay or accept.
9. Prohibited Conduct & Content
You may not use SwankageTCG to commit fraud, sell counterfeit or stolen property, manipulate prices or reviews, harass other users, distribute malware, scrape or overload the service in a harmful manner, interfere with security controls, evade fees through off-platform arrangements initiated to bypass the marketplace, or violate applicable law. We may remove content, cancel listings, restrict features, suspend accounts, or preserve information when reasonably necessary to protect users, the marketplace, or legal rights.
10. Fees, Taxes & Payment Services
Applicable marketplace fees, commissions, payment-processing charges, shipping charges, taxes, and other amounts will be displayed or governed by the relevant vendor, checkout, or policy pages. Users are responsible for taxes and reporting obligations that apply to them. Payment services may be provided by third-party processors and may also be subject to those providers' terms.
11. Intellectual Property
SwankageTCG branding, site design, software, original text, and original marketplace content are protected by applicable intellectual-property laws. Trading-card names, characters, artwork, logos, set names, and other third-party intellectual property belong to their respective owners. Reference to a third-party game, card, grading company, or brand does not by itself imply sponsorship or endorsement.
12. Disclaimers & Limitation of Liability
The marketplace is provided on an “as is” and “as available” basis to the extent permitted by law. SwankageTCG does not guarantee uninterrupted operation, vendor performance, customer performance, card authenticity, grading outcomes, market prices, carrier performance, or that every listing or catalog entry will be error-free.
To the maximum extent permitted by applicable law, SwankageTCG and its owners, affiliates, service providers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, loss of data, loss in collectible value, or losses caused by third-party customers, vendors, payment providers, grading companies, or shipping carriers. Any limitation in these Terms applies only to the extent it is lawful and does not exclude liability that cannot legally be excluded.
13. Suspension & Termination
We may suspend, restrict, or terminate access to accounts or marketplace features when we reasonably believe a user has violated these Terms, created security or fraud risk, failed to pay amounts due, abused other users, or exposed the marketplace to legal or operational risk. Where appropriate, outstanding transactions, refunds, disputes, fees, or legal obligations may survive termination.
14. Third-Party Services
SwankageTCG may link to or rely on third-party services such as payment processors, shipping carriers, analytics providers, social networks, grading companies, and external card-data sources. Those services are operated independently and may have their own terms and privacy practices. SwankageTCG is not responsible for the availability or conduct of third-party services beyond responsibilities that applicable law places on SwankageTCG.
15. Changes to These Terms
We may update these Terms as the marketplace changes. The current version will be posted on this page with an updated revision date. When required by law, we will provide additional notice or obtain consent. Continued use after an update becomes effective constitutes acceptance where permitted by law.
16. Severability, No Waiver & Entire Agreement
If a provision of these Terms is found unenforceable, the remaining provisions continue in effect to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms, together with policies and terms expressly incorporated by reference, form the agreement governing use of the marketplace.
